What Is TDIU?

TDIU (Total Disability Individual Unemployability) allows veterans to receive compensation at the 100% disability rate even if their combined VA rating is less than 100% — as long as service-connected disabilities prevent substantially gainful employment.

"Substantially gainful employment" means earning above the federal poverty threshold (~$14,580/yr). Marginal work, sheltered employment, or part-time work due to your disabilities does NOT necessarily disqualify you. File using VA Form 21-8940.

One-Condition Rule
One condition rated 60% or higher
AND service-connected disabilities prevent substantially gainful employment.
Two-Condition Rule
Combined 70%+ with one condition at 40%+
AND service-connected disabilities prevent substantially gainful employment.
Extra-Schedular TDIU
Even if rating thresholds aren't met
VA can grant TDIU under 38 CFR § 4.16(b) if exceptional circumstances exist. Requires VSO assistance.
